QUALIFICATION/PERMIT ELIGIBILITY

An eligible permittee is someone who is engaged in full-time, year-round employment or full-time employment which is less than year-round, but traditionally exceeds eight (8) months each calendar year and recurring annually in the support of the operation and management of Yosemite National Park and includes those engaged in the operation and management of the El Portal Administrative Site.

Persons supporting the operation and management of Yosemite National Park and the El Portal Administrative Site shall be employed in one of the following categories:

• Federal Government

• Federal Court System

• U.S. Postal Service

• Mariposa County employees who are employed either in Yosemite National Park or the El Portal Administrative Site

• National Park Service concessionaires

• Yosemite Conservancy

• Nature Bridge

• Mariposa County Unified School District teachers and staff assigned to Yosemite National Park and El Portal Administrative Site.

• National Park Service perrmitee who provide educational, civic, medical, social welfare, or other community services to the residents of

Yosemite National Park or the El Portal Administrative Site as determined by the Superintendent

Why do I need a permit from NPS to purchase a house in El Portal?

A portion of El Portal (EP) is located in the El Portal Administrative site which is a land use designation within the boundaries of Yosemite National Park. This means that EP Administrative site land is owned by the Federal Government- DOI NPS.

If I purchase a house in EP what am I actually buying?

You are purchasing personal property from a private party, not the federal government; that is located on federal land. The house is yours. The land is owned by DOI NPS. The NPS permit allows use and access.

How do I determine the value of the house and what I should bid?

House types in EP have the historical (10yrs) values of:

Teardown: $135k-$240k

Fixer: $350k-$400k

Turnkey: $425k+

How do I obtain a permit or check for eligibility?

How do I see the inside of the house?

There will be an open house on January 10th, 2025 @ 2-4pm and

January 11th, 2025 @ 11am- 2pm

Do NOT wait until after the open house to submit your Approval as Qualified Buyer Request form to NPS.

What is the step by step process, how does this all work!?

1. Determine if you are eligible to purchase personal property in EP, download the Approval as Qualified Buyer form below, fill and submit the form to:

Be sure to follow up with the Superintendents office one week after you submit your eligibility form.

2. After you receive approval from NPS; use the contact form below to schedule a tour of the house, guest quarter/office and land.

3. After you have received approval from NPS and toured the property; email your Proof of funds (document or screen shot of bank account with enough cash for your highest offer), approval of qualified buyer with NPS official signature and your highest offer using the contact form below.

4. The seller will review the offer and respond with acceptance, partial acceptance and modification of terms, or rejection.

5. Your offer is accepted.

6. After escrow is open you will make a earnest money deposit to the escrow account of $10,000 within 3 days of escrow being opened.

7. The Title office will assist you in a Transfer of Ownership form between the buyer, the seller and NPS.

8. Three days before the close of escrow (COE) you will deposit the remaining amount due to fund the escrow.

9. The day of COE, title of the personal property will be recorded in your name and you will be the owner.

10. You take possession of the personal property (house).

What are the terms of the sale?

Cash sale, No seller financing and No bank loans.

Close of escrow will be 30 days or sooner and may be shorter if both buyer and seller agree.

Title and escrow company will be Intercounty Title Company, Mariposa.

Earnest money deposit is $10,000 or more.

Any buyer ordered inspections, buyer escrow or recording fees, notary fees, buyer ordered services or consultants fees are the responsibility of the buyer.

Seller is responsible for seller escrow and associated fees, any unpaid taxes or liens. Any inspections, services, or consultant fees ordered by the seller.

Potential buyer will represent themselves or utilize a qualified consultant and never engage a real estate agent or broker. This is not a real estate transaction.

VISITING, USE, READING, OR ENGAGING THS WEBSITE CONSTITUTES SIGNING OF THIS INDENMITY AGREEMENT AS THE INDEMNIFIER:

THIS INDEMNITY AGREEMENT (the "Agreement") made as of this 25th day of December, 2024 (the "Execution Date"),

BETWEEN:

Website Owner and Consultant and
Personal property seller and

DOI- NPS
(collectively and individually the "Indemnitee")

OF THE FIRST PART

and

Website visitor/user in their personal or official capacity, and
Potential Buyer
(collectively and individually the "Indemnifier")

OF THE SECOND PART

BACKGROUND:

The Indemnitee desires protection against any personal liability, claim, suit, action, loss, or damage that may result from the Indemnitee's participation in the Indemnitee.
The Indemnifier wishes to minimize any hardship the Indemnitee might suffer as the result of any personal liability, claim, suit, action, loss, or damage that may result from the Indemnitee's participation in the Indemnitee.

IN CONSIDERATION and as a condition of the Indemnifier and the Indemnitee entering into this Agreement and other valuable consideration, the receipt and sufficiency of which consideration is acknowledged, the Indemnifier and the Indemnitee agree as follows:

Definitions
The following definitions apply in the Agreement:
1. "Indemnitee" means the following:
  As a visitor/user of this website the Indemnifier agrees not to: copy, partially or in full any part of this website, use the website with ill intent, use the website in any way to bring harm, loss, claim, suit, or damage to the Indemnitee. Indemnifier also agrees to pay damages of $10,000 per word for any copy of words on noagent.house to the Indemnitee.
2. "Expenses" means all costs incurred in the defense of any claim or action brought against the Indemnitee including lawyers' fees.
3. "Notice of Claim" means a notice that has been provided by the Indemnitee to the Indemnifier describing a claim or action that has or is being brought against the Indemnitee by a Third Party.
4. "Notice of Indemnity" means a notice that has been provided by the Indemnitee to the Indemnifier describing an amount owing under this Agreement by the Indemnifier to the Indemnitee.
5. "Parties" means both the Indemnitee and the Indemnifier.
6. "Party" means either the Indemnitee or the Indemnifier.
7. "Third Party" means any person other than the Indemnifier and the Indemnitee.
Indemnification
The Indemnifier will hold harmless and indemnify the Indemnitee against any and all claims and actions arising out of the participation of the Indemnitee in the Indemnitee, including, without limitation, Expenses, judgments, fines, settlements and other amounts actually and reasonably incurred in connection with any liability, suit, action, loss, or damage arising or resulting from the Indemnitee's participation in the Indemnitee, subject to the limits on indemnification described in the section titled Exceptions to Indemnification. Where prohibited by law, the above indemnification does not include indemnification of the Indemnitee against a claim caused by the negligence or fault of the Indemnitee, its agent or employee, or any third party under the control or supervision of the Indemnitee, other than the Indemnifier or its agent, employee or subcontractor.
In the case of a criminal proceeding, the Indemnifier will indemnify the Indemnitee against all amounts including, without limitation, Expenses, judgments, fines, settlements, and other amounts actually and reasonably incurred by the Indemnitee.
